Terms of Service

Last updated: September 24, 2026 · ≈ 18 minute read · ~ 9,500 words

These Terms are the authoritative description of what Creo Fleur Atelier — a New Jersey-incorporated, Hoboken-based luxury silk house specialising in made-to-order reversible silk bomber jackets, men's silk pocket squares, silk scarves and sarongs, hand-finished leather Demi-Lune bags, and bridal silk pieces — sells, how it is made, what we represent, and the legal relationship between you and us. Where website copy elsewhere is poetic or summary, these Terms control.

PLEASE READ SECTION 28 (MANDATORY ARBITRATION & CLASS-ACTION WAIVER) CAREFULLY. IT REQUIRES YOU TO RESOLVE DISPUTES WITH US ON AN INDIVIDUAL BASIS THROUGH BINDING ARBITRATION AND LIMITS THE REMEDIES AVAILABLE TO YOU. YOU MAY OPT OUT OF ARBITRATION WITHIN THIRTY (30) DAYS AS DESCRIBED BELOW.

1. Agreement to These Terms

These Terms of Service ("Terms") form a binding agreement between you ("you," "Customer," "User") and Creo Fleur Atelier Corp., a New Jersey corporation with offices at 50 Harrison Street, Hoboken NJ 07030 ("Creo Fleur Atelier," "the Atelier," "we," "us," "our"). By accessing creofleuratelier.com (the "Site"), creating an account, placing an order, or otherwise interacting with our services, you confirm that you have read, understood, and accepted these Terms in full and that you have the legal authority to enter into them. If you do not agree, do not use the Site and do not place an order. Acceptance occurs at the earliest of: (i) clicking any "I agree" or equivalent affirmation, (ii) creating an account, (iii) placing an order, or (iv) continued browsing of the Site after notice of these Terms.

2. Defined Terms

In these Terms, the following capitalised terms have the meanings set out below. Other capitalised terms are defined in the section in which they first appear.

  • "Atelier" — Creo Fleur Atelier Corp., the design studio, and the brand registered to it.
  • "Customer," "you" — the natural person or legal entity entering into a transaction with us.
  • "PDP" — the product detail page on the Site for a specific product.
  • "Made-to-Order Piece" — any product produced individually upon Customer order, which constitutes the majority of the catalog.
  • "In-Stock Piece" — any product clearly designated on the PDP as "in stock" or "ready to ship."
  • "Order Confirmation" — the email we send confirming acceptance of an order; the contract is formed at this moment.
  • "Site Content" — all text, photographs, video, illustrations, designs, patterns, logos, names, and other material made available through the Site.
  • "Customer Content" — anything you submit, post, or transmit to or through the Site, including reviews, photographs, social-media tags, and account information.
  • "Applicable Law" — the laws and regulations applicable to your use of the Site or your purchase, including U.S. federal law, the law of the State of New Jersey, and the consumer-protection law of the jurisdiction in which you are resident, to the extent each applies.

3. Eligibility & Capacity

The Site and its services are intended for users who are at least eighteen (18) years of age (or the age of legal majority in your jurisdiction, if higher) and who have the legal capacity to enter into binding contracts. By using the Site or placing an order, you represent and warrant that you meet these requirements, that the information you provide is accurate and complete, that you are not using the Site on behalf of a sanctioned party (Section 16), and that your use of the Site does not violate any law or regulation applicable to you. We may, at any time and at our sole discretion, request reasonable verification of identity, age, or shipping authority.

4. User Accounts & Security

You may browse the Site without an account. Some features (saved addresses, order history, store credit) require a free account. You are responsible for the confidentiality of your credentials and for all activity that occurs under your account, whether or not authorised by you. You agree to (a) provide accurate, current, complete information, (b) update that information promptly when it changes, (c) notify us immediately at hello@creofleuratelier.com of any unauthorised use of your account or any breach of security, and (d) ensure you log out at the end of each session on a shared device. We may suspend or terminate an account at our discretion under Section 23 (Customer Conduct & Suspension), including for suspected fraud, breach of these Terms, or activity that places the Atelier or other Customers at risk.

5. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates Applicable Law or any applicable contract or court order;
  • Attempt to gain unauthorised access to any portion of the Site, our APIs, our backend systems, our payment processor, our email service, or any account that does not belong to you;
  • Probe, scan, or test the vulnerability of any system or network or breach any security or authentication measures;
  • Use the Site to transmit harmful code, malware, or to launch automated scraping of price, image, inventory, or customer data;
  • Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our prior express written permission;
  • Use any meta tags, hidden text, or any other hidden text utilising the Atelier's name or trademarks;
  • Frame, mirror, or in-line link any portion of the Site without our prior express written permission;
  • Interfere with, circumvent, or disable any security or other technical measure of the Site;
  • Use the Site to send unsolicited communications, promotional material, or "spam";
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the Site or its supporting infrastructure;
  • Use Site Content to train, fine-tune, or evaluate any artificial intelligence model, dataset, or machine-learning system, in whole or in part;
  • Resell, redistribute, or reproduce our product imagery, descriptions, trade dress, or pattern compositions without our prior written permission;
  • Engage in any activity that imposes an unreasonable load on our infrastructure or that we reasonably believe may damage, disable, overburden, or impair the Site.

6. Intellectual Property

All Site Content — including text, photographs, video, illustrations, logos, design names ("La Promise," "La Cathédrale," "Le Demi-Lune," "L'Estampe Japonaise," "Coussin Médaillon Persan," "Pochette," and all other product, collection, and series names), pattern compositions, colourways, trade dress, and product designs — is owned by Creo Fleur Atelier or used under licence, and is protected by copyright, trademark, trade-dress, unfair-competition, and applicable international intellectual-property law.

Subject to your strict compliance with these Terms, we grant you a limited, personal, non-commercial, non-exclusive, revocable, non-transferable, non-sublicensable licence to access and view the Site and the Site Content for the sole purpose of evaluating and purchasing our products. All other rights are expressly reserved. No licence is granted to you, by implication, estoppel, or otherwise, in any Atelier name, mark, logo, or design.

You may not, and may not authorise any third party to: (a) reproduce, distribute, publicly display, publicly perform, modify, adapt, create derivative works from, or commercially exploit any Site Content; (b) ingest any Site Content into a generative artificial-intelligence model, search index, large-language-model training corpus, or other automated system; (c) remove, obscure, or alter any copyright, trademark, watermark, or other proprietary notice; (d) imitate or use any trade dress, layout, or distinctive visual design of the Site; or (e) register any domain name, social-media handle, or trademark that is identical to, confusingly similar to, or designed to invite confusion with any Atelier name. Limited personal, non-commercial use (saving a single product image to a personal mood board, sharing a Site link on social media with attribution) is permitted; bulk scraping, model-training ingestion, and commercial reuse are not.

7. Customer Content & Reviews

When you submit Customer Content (including, by way of example, product reviews, photographs you tag with our handle on social media, written feedback, or testimonials), you grant us a perpetual, irrevocable, royalty-free, fully paid-up, worldwide, sublicensable, transferable licence to use, reproduce, distribute, display, publicly perform, modify, and create derivative works from that Customer Content, in any media now known or later developed, for any purpose, including marketing, advertising, editorial, and product development. You represent and warrant that you own or otherwise control all rights necessary to grant this licence and that your Customer Content does not infringe the rights of any third party. You may withdraw consent for use of any specific item of Customer Content prospectively by writing to legal@creofleuratelier.com; we will use reasonable efforts to discontinue future use within thirty (30) days of receipt.

Nothing in this Section 7, or anywhere in these Terms, restricts your right to publish honest reviews of our products or services in any forum, or penalises you for doing so. We do not condition any sale, refund, exchange, or service on the suppression, modification, or favourable framing of a review. This commitment is consistent with the Consumer Review Fairness Act (15 U.S.C. § 45b) and equivalent law of other jurisdictions, and we will not enforce any contrary provision.

8. Product Composition & Provenance

The following describes, in plain language, how each Creo Fleur Atelier product is made. This Section 8 is the authoritative description and supersedes any inconsistent marketing copy elsewhere on the Site.

8.1 Design origin

Each motif, pattern, and seasonal direction is developed and curated at our atelier in Hoboken, NJ (in the New York City metropolitan region). Compositions are original to Creo Fleur Atelier, developed under the artistic direction of the Atelier from a combination of original ideation, archival reference (public-domain heritage textiles, period botanicals, original studies), and contemporary visual direction. Our composition workflow may include the use of digital composition tools — including AI-assisted rendering software — operated under the curatorial direction of the Atelier; the final compositions and the artistic decisions about them are ours and constitute original works of authorship attributable to Creo Fleur Atelier.

8.2 Production

Approved compositions are sent to our production workshop partner located in London, United Kingdom. At that workshop: (a) the composition is reactive-dyed onto natural-fibre silk substrates (or, for non-silk products, printed using the appropriate dye-sublimation or reactive process for that substrate); (b) the printed fabric panels are cut, sewn, and finished by hand by professional garment workers; and (c) the finished item is inspected, pressed, packed, and shipped directly to the Customer. We refer to this facility on the Site as our "London workshop" or "London workshop partner." The identity of this third-party partner is confidential commercial information of Creo Fleur Atelier; we will identify the partner only as required by law or to satisfy a regulator with jurisdiction.

8.3 Materials

The exact silk weight, fibre content, leather grade, or other material composition of each product is stated on the individual product detail page ("PDP"). The PDP material specification controls; any general "silk" or "leather" reference elsewhere on the Site is subject to the specific PDP description. Where a product is offered in multiple fabric options (e.g., Mulberry Silk Habotai, Silk Twill, Silk Satin, Silk Georgette, polyester chiffon), the variant title at the moment of purchase governs the material the Customer receives. If a PDP and a marketing component on the Site disagree, the PDP wins.

8.4 Made-to-order & natural variation

Small differences in screen colour or print placement can occur. This does not excuse the wrong design, material, size or cut, faulty stitching, or a material difference from the description or published measurements. We do not apply an undisclosed blanket size tolerance to dismiss a claim.

8.5 Material substitution

If an ordered material becomes unavailable, we will contact you to choose an available alternative, agree a revised date, or cancel for a full refund. We will not substitute a material without your express agreement. Silence is not consent to a different piece or an extended delivery date.

8.6 What our marketing terms mean

For the avoidance of doubt, the following marketing terms used on the Site carry the following defined meanings:

  • "Atelier" refers to our design studio in Hoboken, NJ where compositions originate. It does not represent a physical painting or hand-applied-pigment workspace.
  • "Workshop" or "London workshop" refers to our third-party production partner located in the United Kingdom.
  • "Reactive-dyed" refers to the industrial reactive-dye printing process used on silk and natural fibres. It is not a hand-application method.
  • "Hand-finished," "hand-cut," "hand-sewn" refer specifically to the human cutting, sewing, and finishing labour performed by professional garment workers at our London workshop. They do not refer to the printing step, which is mechanical.
  • "Made-to-order" means the piece is not pulled from existing stock; it is produced after the order is placed.
  • "Single-piece production" means each printed piece is its own print run, fired individually for the order.
  • "Heirloom," "atelier-grade," "couture" and similar terms are aesthetic descriptors of the brand register and the materials' durability potential. They are not legal warranties of any particular service life.

Creo Fleur Atelier does not represent that any printed product is hand-painted, block-printed, screen-printed, or that pigment is applied to the substrate by a human hand. Pieces are not individually signed by an artist and are not issued as numbered editions unless a specific limited edition is expressly designated on the PDP and confirmed in the Order Confirmation.

9. Pricing, Payment, Currency & Taxes

Prices are displayed in U.S. Dollars (USD) unless otherwise indicated and are subject to change without notice. The price in effect at the time of Order Confirmation governs. Choose from the payment methods displayed at checkout. Availability depends on your location, currency, order and the payment provider's eligibility checks. If you choose an instalment or pay-later option, review that provider's payment schedule and terms before confirming. Payment authorization, collection and any repayment schedule are handled by the selected provider; we do not store full payment-card data on our own systems.

Pricing errors. Despite our reasonable efforts, a small number of products on the Site may, from time to time, be mispriced as a result of typographical, photographic, or technical error. We reserve the right to correct any error in the price of a product on the Site at any time. If the correct price of a product you have ordered is higher than the stated price, we will, at our discretion, either contact you for instruction before accepting the order or treat the order as not accepted under Section 11. We are under no obligation to provide a product to you at the incorrect (lower) price, even after Order Confirmation, where the error is obvious and unmistakable and could reasonably have been recognised by you as a mispricing.

Taxes. Displayed product prices include applicable sales tax collected by Creo. The tax breakdown is shown at checkout without adding that sales tax to the displayed product price. International import duties and customs charges may apply separately; see Section 15 (Customs & Duties).

Fraud screening & chargebacks. All orders are subject to verification by us and our payment processors. We may decline an order, request additional verification (including government-issued identification matching the cardholder name and shipping address), or cancel an order at any time prior to dispatch where we, acting in good faith, suspect payment fraud, identity fraud, account takeover, stolen-instrument use, or other unlawful conduct. You agree not to initiate a chargeback for any reason for which we offer a clear remedy under these Terms (including Section 19 returns and Section 20 defective-goods remedies) without first contacting us in writing and allowing thirty (30) days for resolution. Wrongful chargebacks may result in account suspension under Section 23 and may be challenged through the payment-processor dispute process.

10. Promotional Codes & Loyalty Credits

Promotional codes are valid only on the terms communicated with each code (eligible products, validity window, per-customer use limit, expiration). One promotional code per order; promotional codes are not stackable unless expressly stated. Promotional pricing may not be applied retroactively to orders already placed. Promotional codes have no cash value, are non-transferable, are not redeemable for cash, and may be cancelled, modified, or rescinded by us at any time prior to use. We reserve the right to disqualify orders that we determine, in good faith, abuse a promotional code (including, by way of example, bulk-buying with intent to resell, technical exploitation of a code's terms, or use of multiple accounts to evade per-customer limits). Store credit issued under Section 19 is non-transferable, is not redeemable for cash except where required by Applicable Law, and expires twelve (12) months after issuance.

11. Orders & Order Acceptance

Placing an order through the Site is an offer by you to purchase the listed product on the terms of these Terms and the PDP. An order is accepted by us only when we send an Order Confirmation email and charge your selected payment method. Until that confirmation is sent, no contract is formed and any earlier communication (including an automated checkout receipt) is acknowledgement of receipt only, not acceptance of an offer. The contract is formed at the moment we send the Order Confirmation, on the version of these Terms in effect at that moment.

Even after Order Confirmation, we may cancel the order in whole or in part at any time prior to dispatch where (a) the product is materially mispriced as set out in Section 9; (b) we identify, in good faith, evidence of fraud, identity misrepresentation, or other unlawful conduct relating to the order or the Customer; (c) the requested shipping address is in a Restricted Jurisdiction (Section 16); (d) inventory of a critical input (including a specific fabric, leather, or hardware) becomes unavailable and Section 8.5 substitution is declined; (e) the order is part of an apparent reseller pattern in violation of Section 12; or (f) we are unable to obtain payment authorisation. If we cancel an accepted order under this Section 11 for any reason other than your fault, our sole obligation is to refund the amount you paid for the cancelled portion to the original payment method.

12. Right to Refuse Sale

Creo Fleur Atelier is a private commercial enterprise and reserves the right, at our sole discretion and consistent with the common-law principle of freedom to contract, to refuse to sell to, decline to do business with, or terminate the relationship with any prospective or existing Customer for any lawful reason, including but not limited to those set out below. We do not, and will not, refuse service on the basis of any characteristic protected by Title II of the Civil Rights Act of 1964 (42 U.S.C. § 2000a), the New Jersey Law Against Discrimination (N.J.S.A. 10:5-1 et seq.), 42 U.S.C. § 1981, or any other Applicable Law prohibiting discrimination in places of public accommodation, including (without limitation) race, colour, religion, national origin, sex, gender identity or expression, sexual orientation, age, disability, marital status, military or veteran status, source of income, or any other protected characteristic.

Subject only to the foregoing non-discrimination commitment, the lawful business reasons for which we may refuse, decline, cancel, suspend, or terminate include, by way of example and without limitation:

  • Suspected payment fraud, identity fraud, account takeover, friendly fraud, or use of stolen payment instruments;
  • Prior chargeback history or other unresolved payment disputes with us;
  • Apparent intent to resell our products in a manner inconsistent with Section 13 (Anti-Resale);
  • Shipping addresses in any country, region, or facility on a U.S. or other Applicable sanctions list, or to any party named on any U.S. Government denied-parties list (see Section 16);
  • Pattern of returns, exchanges, or chargebacks that, in our reasonable judgement, indicates abuse of our policies;
  • Conduct toward our staff, contractors, or other Customers that is abusive, threatening, harassing, or otherwise inconsistent with a respectful commercial relationship;
  • Reasonable concern that the order is intended for any unlawful purpose, or that the Customer has used or intends to use our products or Site Content for any unlawful purpose;
  • Material breach of these Terms or of any prior agreement with us;
  • Quantity, frequency, or geography of orders that, in our judgement, exceeds normal personal-consumption patterns and may indicate distribution, counterfeiting, sample diversion, or grey-market activity;
  • Any other lawful business reason consistent with our brand standards, our risk-management policies, or the protection of our other Customers and our staff.

Where we exercise our right under this Section 12 with respect to an accepted order, our sole obligation is to issue a full refund to the original payment method for any amounts already charged. We are not obliged to provide a reason for any refusal, except as required by Applicable Law; where we do provide a reason, the provision of that reason is not a waiver of any other ground on which we could lawfully have refused.

13. Anti-Resale & Authorised Channels

Our products are offered for sale to end-Customers for personal, non-commercial use, and (where the product is suitable) for legitimate gift-giving. Creo Fleur Atelier does not authorise any reseller, marketplace, drop-shipper, third-party vendor, or "luxury concierge" service to offer or resell our products. The only authorised sales channel is creofleuratelier.com. Purchases made for the purpose of commercial resale, parallel import, or onward distribution through an unauthorised channel are a material breach of these Terms and are grounds for refusal under Section 12, cancellation under Section 11, account termination under Section 23, and (where appropriate) civil action for unfair-competition, trademark, or trade-dress harm. We monitor third-party marketplaces and reserve all rights against unauthorised resellers, including takedown demands, brand-protection enforcement, and recovery of profits and legal fees as permitted by Applicable Law.

14. Shipping, Risk of Loss & Title

Made-to-Order Pieces: Made in 5 days. Delivered in the next 5. Around 10 calendar days, all told. Delivery is estimated, not guaranteed. Destination, holidays, customs and carrier delays may affect arrival. Refer to the product page for item-specific availability. Where we arrange delivery, we remain responsible for loss or damage until the piece is delivered to you or your nominated recipient. Ownership passes on delivery once payment is complete. If we cannot meet an agreed dispatch date, we will notify you and seek consent to a revised date or provide cancellation and refund as required by law. If your parcel is overdue or tracking shows delivered but it has not arrived, contact us with your order number. We will investigate with the carrier. If it is confirmed lost before delivery, you may choose a replacement or a full refund. Carrier enquiries do not override your statutory remedies. Please tell us promptly about an incorrect delivery address so we can explore the available options. International import charges are addressed in Section 15. For full shipping detail see our Shipping & Returns page.

15. Customs, Duties & Import Compliance

You are the importer of record for any shipment delivered to an address outside the United States. You are responsible for ensuring the lawful importation of the product into the destination jurisdiction, paying all customs duties, value-added or goods-and-services tax, brokerage fees, and any other import charges assessed by the destination customs authority, and for ensuring that the product complies with destination-country labelling, materials, and consumer-product law. We do not under-declare value or mark commercial shipments as "gift" on customs documentation. Where a shipment is refused at customs, abandoned, returned-to-sender, or destroyed by a customs authority, the original shipping cost is non-refundable and the Customer is responsible for any return-shipping or destruction fee assessed against us, which we may set off against the product refund.

16. Restricted Jurisdictions, Sanctions & Export Control

You represent and warrant that you are not located in, organised under the law of, or ordinarily resident in any country, region, or jurisdiction subject to comprehensive U.S. economic or trade sanctions administered by the U.S. Department of the Treasury's Office of Foreign Assets Control ("OFAC"), and that you are not identified on any OFAC denied-parties list (including the Specially Designated Nationals and Blocked Persons List), the U.S. Commerce Department Bureau of Industry and Security Entity List, the U.S. State Department Debarred List, the U.S. Department of Defense's Section 1260H list, or any equivalent list maintained by the United Kingdom (HM Treasury Consolidated List), the European Union, Canada, Australia, Japan, the United Nations Security Council, or any other Applicable Law authority with jurisdiction over our operations. You will not use the Site or any product purchased through the Site in violation of any U.S. or other Applicable export-control or sanctions law. We may screen orders against published sanctions and denied-parties lists and may cancel any order at any time on the basis of such screening without further explanation.

17. Returns, Exchanges & Refunds

Returns & refunds

The short version

Can I cancel?
Yes, within 24 hours. From when you place your order. Full refund; your email's sent time counts.
Does the fit need attention?
Eligible fit returns and exchanges are welcome. This includes standard made-to-order pieces. Contact us before returning; the atelier assesses each piece against the published conditions after receipt. A change of preference alone is not a voluntary return reason.
Damaged, faulty or wrong item?
Yes. Refund or replacement. Once we confirm the issue, you choose. Store credit is never required instead of a refund.
What is the return window?
Up to 21 days from delivery for eligible domestic returns. Received within 14 days: original-payment refund or store credit. Received on days 15-21: store credit. Contact us promptly so we can provide return instructions. Statutory deadlines and remedies are separate.
How and when am I refunded?
Back to the way you paid. 5-7 business days after approval or receipt of a required return, plus bank processing time. Shorter legal deadlines still apply.
Who pays return postage?
We pay for confirmed faults, damage or wrong items. Otherwise, you pay unless agreed otherwise or the law requires us to pay. Contact us before posting.
Buying in the UK or EU?
Extra return rights may apply. Eligible non-personalised items: tell us within 14 days of delivery, then return within another 14 days. Refunds include standard outbound shipping. Genuinely personalised items are excluded from this change-of-mind right.

Report faults as soon as possible, ideally within 14 days, and delivery damage within 48 hours. These are reporting targets, not a deadline that removes your rights.

Eligible fit returns and exchanges are welcome, including standard made-to-order pieces, subject to return conditions and inspection. Faulty items and statutory returns remain covered.

Start a return enquiry

17.1 A little room to reconsider

You may cancel within 24 hours of placing your order for a full refund. Email returns@creofleuratelier.com with your order number; the time you send your request counts, not when we reply.

After this window, contact us promptly. We will check the actual production status before confirming whether a change or cancellation is possible. Order confirmation alone does not mean production has begun. This does not limit any statutory cancellation right.

17.2 Made for your order

Standard catalogue pieces made after you order are not automatically final sale. We accept voluntary domestic returns for genuine fit issues, such as a piece being too small or too large, including when the size supplied is correct. Contact returns@creofleuratelier.com before sending it back. Eligible returns received within 14 calendar days of delivery qualify for a refund to the original payment method or store credit; eligible returns received on days 15-21 qualify for store credit. A size exchange may be requested within the same window, subject to availability and the new piece's production time. A change of preference alone is not a voluntary return reason. Genuinely personalised or individually altered pieces are excluded from this voluntary fit-return offer unless we agree otherwise; faulty-item and statutory rights remain unaffected.

The same voluntary domestic fit-return window applies to in-stock pieces. Try the garment on indoors with care; do not wear, wash, alter or damage it. Keep the tags attached and include its original packaging where reasonably available. After receipt, our team assesses each return individually against the stated reason, timing and condition, not an undisclosed standard. We will explain any decision to decline and offer a review. Return authorisation is not final acceptance, but a correctly supplied size alone is not grounds to reject a genuine fit issue. If our instructions are delayed, the affected window is extended by that delay. Exchanges carry no processing fee and domestic exchange delivery is complimentary; non-faulty return postage remains the customer's responsibility. Store credit is valid for 12 months, or longer where required by law. These voluntary conditions never remove faulty-item or statutory remedies.

17.3 If something is not right

If your piece arrives damaged, faulty, incorrect or materially different from its description, email returns@creofleuratelier.com. We will help resolve it.

For a confirmed faulty, damaged or incorrectly supplied piece, you may choose a replacement or a full refund to your original payment method. A repair or store credit is available only if you agree; store credit is never required instead of a refund you are entitled to. Any additional remedies required by law remain available.

Please inspect your piece on arrival and tell us about a fault as soon as possible, ideally within 14 days. This is a request for prompt reporting, not a deadline that removes your rights or excludes a fault discovered later.

For delivery damage, contact us as soon as possible, ideally within 48 hours. Photograph the piece and packaging if possible, and keep them while we investigate. A later report does not automatically invalidate your claim.

Small differences in screen colour or print placement can occur. This does not excuse the wrong design, material, size or cut, faulty stitching, or a material difference from the description or published measurements. We do not apply an undisclosed blanket size tolerance to dismiss a claim.

17.4 Your statutory return rights

Where UK or EU consumer withdrawal rules apply, non-personalised online purchases can be cancelled without giving a reason within 14 days after delivery, with another 14 days to send the goods back after notifying us. The exception is for goods genuinely made to your individual specifications or clearly personalised, not simply made after you order from our standard catalogue. You may inspect or try on a piece as you would in a shop; handling beyond that may result in a lawful deduction for diminished value. Faulty-item rights apply even to personalised pieces.

For a valid statutory withdrawal, we refund the item price and the applicable standard outbound delivery charge, not any extra charge for an upgraded service. Refunds are due within 14 days of cancellation, although where permitted we may withhold payment until the goods arrive or you provide evidence of return, whichever is earlier. No restocking or production fee applies to a valid statutory withdrawal. Other non-waivable local consumer rights remain protected.

17.5 Returning a piece

Include your order number or other proof of purchase, a description of the issue, and your preferred resolution. If possible, attach a full view, a close-up of the issue and the label or packaging. If you cannot provide photographs, contact us for help; photographs are not a condition of your statutory rights.

Contact Creo before sending a piece back so we can provide the correct return address and instructions. Do not send it directly to our manufacturing partner or the address on the parcel without our instructions. Keep proof of posting and use a tracked service. A return-authorisation request must not delay or prevent a valid statutory cancellation.

For a confirmed faulty, damaged or incorrect piece, Creo covers reasonable return-shipping costs. We will arrange a label or agree reimbursement before you post it. For a voluntary fit return or statutory withdrawal of a non-faulty item, you pay the direct return cost unless we agree otherwise or law requires us to pay. Original packaging is helpful for faulty items but is not required to exercise statutory rights.

17.6 Refunds and exchanges

Eligible refunds are processed to the original payment method within 5-7 business days after approval, or receipt of a required return, subject to any shorter legal deadline. Your bank may take additional time to display the credit. Exchanges and store credit are processed within 3-5 business days of receiving an eligible return. We explain any lawful deduction before processing it. Supplier cancellation charges are not automatically deducted from your refund.

17.7 An overdue or missing parcel

If your parcel is overdue or tracking shows delivered but it has not arrived, contact us with your order number. We will investigate with the carrier. If it is confirmed lost before delivery, you may choose a replacement or a full refund. Carrier enquiries do not override your statutory remedies. Please tell us promptly about an incorrect delivery address so we can explore the available options.

17.8 A personal resolution

If a proposed resolution does not address your concern, reply to your case email and ask for a review by the atelier, or contact returns@creofleuratelier.com with the earlier correspondence. You do not need to contact our manufacturer to exercise your rights against Creo.

An earlier order keeps the terms offered when it was placed, together with all applicable statutory rights. This revision does not reduce an existing customer's rights.

This policy does not affect your statutory rights.

18. Material Sensitivity & Allergen Disclosure

Our products are made from natural and synthetic materials including (without limitation) silk, leather, cotton, linen, polyester chiffon, reactive and acid dyes, metal hardware, and adhesives. A small percentage of individuals may experience skin sensitivity, irritation, or allergic reaction to one or more of these materials, particularly during initial wear of a freshly dyed silk or leather product. Sensitivity is not a defect of the product. By placing an order, you confirm that you have reviewed the materials specification on the PDP and have determined, to your own satisfaction, that the materials are appropriate for you. If you experience any unusual skin reaction after wearing a product, discontinue use and consult a qualified medical professional. The Atelier expressly disclaims liability for any sensitivity, irritation, or allergic reaction to its products to the maximum extent permitted by Applicable Law, except where caused by our gross negligence or wilful misconduct.

19. Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED IN SECTION 17.3 (DEFECTIVE, DAMAGED, OR NON-CONFORMING PIECES), THE SITE AND ALL PRODUCTS PURCHASED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CREO FLEUR ATELIER EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, AND STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR THAT THE INFORMATION ON THE SITE IS COMPLETE, ACCURATE, OR USEFUL. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US OR THROUGH THE SITE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. Where any non-waivable consumer-protection law applies, our liability is limited to the extent permitted by that law.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CREO FLEUR ATELIER, ITS PARENT, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING (WITHOUT LIMITATION) LOSS OF PROFIT, LOSS OF REVENUE, LOSS OF DATA, LOSS OF USE, LOSS OF GOODWILL, LOSS OF BUSINESS OPPORTUNITY, COST OF SUBSTITUTE GOODS, OR PERSONAL INJURY — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR THE PURCHASE, POSSESSION, OR USE OF ANY PRODUCT, WHETHER UNDER CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO A PARTICULAR ORDER SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID US FOR THAT ORDER IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THIS CAP APPLIES IN AGGREGATE TO ALL CAUSES OF ACTION RELATING TO THAT ORDER.

Nothing in these Terms excludes or limits any liability that cannot be lawfully excluded or limited under Applicable Law, including liability for fraud, fraudulent misrepresentation, gross negligence, or wilful misconduct, or any non-waivable consumer-protection liability. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. The Parties agree that the limitations and exclusions in this Section 20 are an essential basis of the bargain between them and that they would not enter into this contract on different terms.

21. Indemnification & Hold Harmless

You agree to defend, indemnify, and hold harmless Creo Fleur Atelier, its parent, subsidiaries, affiliates, and each of their respective officers, directors, shareholders, employees, agents, contractors, licensors, suppliers, and successors (each, an "Indemnified Party") from and against any and all third-party claims, demands, suits, proceedings, judgements, fines, penalties, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees, expert-witness fees, and court costs) arising from or relating to:

  • Your breach of any provision of these Terms or any document incorporated by reference;
  • Your violation of any Applicable Law, regulation, or third-party right;
  • Your use of the Site, including any reliance on Site Content;
  • Your purchase, possession, or use of any product, including any modification, alteration, or repair you make to the product;
  • Any allergic reaction, sensitivity, or personal injury arising from your contact with the materials of any product, except to the extent caused by our gross negligence or wilful misconduct;
  • Any reproduction, distribution, modification, or commercial reuse of Site Content in violation of Section 6 (Intellectual Property);
  • Any Customer Content you submit, including any claim of infringement, defamation, invasion of privacy, or right of publicity;
  • Any chargeback, dispute, or claim brought by you against your payment processor that we determine, in good faith, was not substantively justified under these Terms;
  • Any violation of customs, import, export-control, or sanctions law arising from your shipment or use of the product;
  • Any unauthorised access to your account caused by your failure to safeguard your credentials;
  • Any reseller, marketplace, or distribution activity in violation of Section 13;
  • Your fraud, gross negligence, or wilful misconduct.

We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defence of that matter. You will not settle any claim subject to indemnification under this Section 21 without our prior written consent. The Indemnified Parties' rights under this Section 21 are in addition to, and not in lieu of, any other rights or remedies available at law or in equity.

22. Force Majeure

We are not in breach of these Terms, and shall not be liable for any failure or delay in performance, where the failure or delay is caused by an event beyond our reasonable control ("Force Majeure Event"), including (without limitation) acts of God; fire, flood, earthquake, hurricane, or other natural disaster; epidemic, pandemic, or quarantine; war, terrorism, civil unrest, riot, or insurrection; lockout, strike, or labour dispute (whether or not involving our employees); failure or interruption of utilities, telecommunications, or internet service; cyber-attack, denial-of-service attack, or similar malicious action; failure of, or material change in policy by, any third-party platform, payment processor, fulfilment partner (including our London workshop partner), or carrier; supply-chain disruption affecting silk, leather, dye, or other input; governmental order, action, or restriction; or imposition of trade restrictions, sanctions, embargo, customs delay, or change in tariff. Where a Force Majeure Event delays performance for more than sixty (60) days, either Party may cancel the affected order and we will refund any amount already paid for the affected portion to the original payment method.

23. Customer Conduct & Account Suspension

We are committed to maintaining a respectful environment for our Customers, our staff, and our contractors. We reserve the right, at our sole discretion, to suspend or terminate your account, refuse current or future orders under Section 12, and pursue any other remedy available under Applicable Law, where you (a) engage in any prohibited use under Section 5; (b) abuse, harass, threaten, defame, or otherwise mistreat any of our staff, contractors, or other Customers in any communication channel (email, telephone, social media, in person, or otherwise); (c) initiate one or more chargebacks that we determine, in good faith, are not substantively justified under these Terms; (d) abuse our returns or exchange policy through repeated, pretextual, or unjustified return requests; (e) attempt to manipulate inventory, pricing, or promotion by automated, repetitive, or pretextual ordering; (f) breach any provision of these Terms; or (g) provide false or misleading information in connection with any order, account, or claim. Suspension is effective on notice; we may, but are not required to, give you an opportunity to cure prior to termination. Upon termination, any pending order may be cancelled at our discretion subject to Section 11, and any outstanding store credit is forfeited. Sections 6, 7, 16, 19, 20, 21, 22, 27, 28, 29, 32, 33, and 34 survive termination.

24. Privacy & Data Protection

Our collection, processing, and storage of personal information is described in the Global Privacy Statement, which is incorporated by reference into these Terms. Accepting these Terms or continuing to browse does not grant optional tracking permission. Where the General Data Protection Regulation (EU 2016/679), the UK GDPR, the California Consumer Privacy Act (Cal. Civ. Code § 1798.100 et seq., as amended by the California Privacy Rights Act), or any other applicable data-protection or privacy law applies to our processing of your personal information, we will honour the rights granted to you under that law in accordance with the procedures set out in our Global Privacy Statement.

Cookie choices. Essential storage supports shopping, checkout, account security and your saved preference. Choosing "I Understand" accepts analytics and marketing, subject to Global Privacy Control. "Customize Settings" lets you choose analytics and marketing separately; only categories you enable and save are allowed. Choosing "Essential only" leaves optional analytics, advertising tags and Clarity off. Closing settings without saving changes nothing. You can change categories through Privacy preferences in the footer; choices are saved on this browser for up to six months. Global Privacy Control keeps optional tracking off. Withdrawing permission may reload the page. Cookie choices do not subscribe you to email. Our Global Privacy Statement describes the providers, masking, replay exclusions and data rights in more detail.

The cookie notice appears on any landing page, including direct product page visits, until you make a choice. Saved preferences are preserved during navigation. An undecided visitor has optional tracking off, and privacy controls remain available in the footer.

25. Marketing Claims & Editorial Discipline

Editorial and marketing copy used elsewhere on the Site, in advertising, on social media, in email campaigns, or by Creo Fleur Atelier through any other channel is intended to convey the brand register, design intent, and customer experience. Where any such copy could be read inconsistently with Section 8 of these Terms or with the PDP for a particular product, Section 8 and the PDP control. Creo Fleur Atelier does not warrant, and expressly disclaims, any representation that could be inferred from editorial or aspirational copy that is not literally true of the production process described in Section 8. If you have a question about whether a specific representation is warranted, please contact us at legal@creofleuratelier.com before purchase.

26. Design Process Disclosure (AI-Assisted Composition)

In the spirit of full transparency, the Customer is informed that our composition workflow described in Section 8.1 may include the use of generative software tools (including AI-assisted image rendering tools) under the Atelier's curatorial direction. The use of such tools is incidental to the creative process and does not alter (a) the originality of the resulting composition as a work attributable to Creo Fleur Atelier, (b) Creo Fleur Atelier's ownership of the composition for the purposes of Section 6, or (c) the physical production process described in Section 8.2, which is performed on physical silk by our London workshop partner using industrial reactive-dye equipment and human cutting, sewing, and finishing labour. Photographs and video on the Site may also include AI-rendered editorial imagery used to convey design context; the underlying physical product is what is delivered.

27. DMCA Notice & Takedown

We respect the intellectual property of others and ask that our Customers do the same. If you believe that any material on the Site infringes a copyright you own or control, please send a notification of claimed infringement to our designated agent containing the elements required by 17 U.S.C. § 512(c)(3):

  • An electronic or physical signature of the person authorised to act on behalf of the owner of the copyright interest;
  • A description of the copyrighted work that you claim has been infringed;
  • A description of where on the Site the allegedly infringing material is located, sufficient to permit us to locate the material;
  • Your address, telephone number, and email address;
  • A statement by you that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law;
  • A statement by you, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorised to act on the copyright owner's behalf.

Send DMCA notifications to our designated agent at legal@creofleuratelier.com with subject line "DMCA Notification," or by mail to: DMCA Agent, Creo Fleur Atelier Corp., 50 Harrison Street, Hoboken NJ 07030. Knowingly material misrepresentation in a DMCA notification may subject you to liability for damages under 17 U.S.C. § 512(f).

28. Mandatory Arbitration & Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO RESOLVE DISPUTES WITH US ON AN INDIVIDUAL, NON-CLASS, NON-CONSOLIDATED BASIS THROUGH BINDING ARBITRATION, AND LIMITS THE FORUM AND REMEDIES AVAILABLE TO YOU. YOU MAY OPT OUT OF THIS SECTION 28 WITHIN 30 DAYS AS DESCRIBED IN SUBSECTION (g) BELOW.

28(a) Informal dispute resolution first

Before commencing arbitration, you and Creo Fleur Atelier agree to first attempt to resolve any dispute informally for a period of at least thirty (30) days. To begin informal dispute resolution, you must send a written notice describing the dispute and the relief you seek to legal@creofleuratelier.com with subject line "Notice of Dispute" and a copy by certified mail to: Creo Fleur Atelier Corp., 50 Harrison Street, Hoboken NJ 07030, Attn: Legal. We will reciprocate. The 30-day informal-resolution period is a pre-condition to the right to commence arbitration.

28(b) Agreement to arbitrate; FAA

If informal resolution does not produce a settlement within thirty (30) days of the Notice of Dispute, you and Creo Fleur Atelier agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, the Global Privacy Statement, any product purchased through the Site, or our relationship (each, a "Dispute") shall be resolved exclusively by final, binding, individual arbitration. This arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq. ("FAA"), and evidences a transaction involving interstate commerce.

28(c) Arbitration administrator and rules

The arbitration shall be administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules in effect at the time the arbitration is commenced (available at www.adr.org). If the AAA is unavailable to administer the arbitration, the parties shall agree on a substitute administrator; if they cannot agree, a court of competent jurisdiction shall appoint one. The arbitrator's decision shall be in writing, shall include the essential findings on which the award is based, and shall be final and binding subject only to the limited review available under the FAA.

28(d) Seat, language, and costs

The arbitration shall be seated in Jersey City, New Jersey, and conducted in the English language. The arbitrator may, in appropriate circumstances and on the request of a Customer, conduct the arbitration by telephone, videoconference, or based solely on submitted documents. Each Party shall bear its own attorneys' fees and costs, except that we will pay the AAA's filing, administrative, and arbitrator fees that exceed those a Customer would have paid to file a civil action in a court of competent jurisdiction, where the dispute involves a claim of less than ten thousand U.S. dollars ($10,000). The arbitrator shall apply Applicable Law as set forth in Section 29 (Governing Law).

28(e) Class-action and class-arbitration waiver

YOU AND CREO FLEUR ATELIER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator shall not consolidate the claims of more than one Party and shall not preside over any form of class or representative proceeding. If a court of competent jurisdiction holds that this Subsection 28(e) is unenforceable as to a particular claim or relief sought, then that claim or request for relief (and only that claim or request for relief) shall be severed from the arbitration and brought in a court of competent jurisdiction; all other claims shall remain in arbitration on an individual basis.

28(f) Mass-arbitration protocol

If twenty-five (25) or more individual demands for arbitration are filed against the Atelier raising substantially similar claims and represented by the same counsel or coordinated counsel within a sixty (60)-day window, the parties agree that the AAA shall, before any individual case proceeds, administer such demands as a single coordinated proceeding for the limited purposes of (a) selecting a panel of bellwether arbitrators, (b) staging a small number of bellwether arbitrations, and (c) attempting global mediation. This provision is intended to ensure efficient, reasoned resolution of similar claims and to discourage the speculative filing of mass arbitration demands designed to extract leverage from the asymmetric administrative cost of mass-arbitration filings. No Customer's substantive rights are diminished by this Subsection 28(f).

28(g) Right to opt out

You may opt out of this Section 28 (and only this Section 28) by sending written notice to legal@creofleuratelier.com with subject line "Arbitration Opt-Out" within thirty (30) days of the date you first accepted these Terms or the date these Terms were materially updated to expand the arbitration provisions. Your opt-out notice must include your full name, the email address associated with your account or order, and a statement that you wish to opt out of arbitration. If you opt out, all other provisions of these Terms (including Section 29 Governing Law and Section 30 Jurisdiction Carve-outs) remain in effect.

28(h) Carve-outs

Notwithstanding anything in this Section 28: (i) either Party may bring an individual action in small-claims court for any dispute within that court's jurisdiction; (ii) either Party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction to protect intellectual-property rights, to prevent disclosure of confidential information, or to protect against immediate, irreparable harm pending arbitration; and (iii) notwithstanding the FAA pre-emption analysis, this Section 28 does not waive any non-waivable right under Applicable Law, including any non-waivable right of a California Customer under the McGill rule (McGill v. Citibank, N.A., 2 Cal. 5th 945 (2017)) to seek public injunctive relief on behalf of the general public.

28(i) Jury-trial waiver

IF FOR ANY REASON A DISPUTE PROCEEDS IN COURT RATHER THAN IN ARBITRATION, EACH PARTY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ANY RIGHT TO A TRIAL BY JURY. EACH PARTY HEREBY ACKNOWLEDGES THAT THIS WAIVER IS A MATERIAL INDUCEMENT TO ENTER INTO A BUSINESS RELATIONSHIP, THAT EACH PARTY HAS RELIED ON THIS WAIVER, AND THAT EACH PARTY WILL CONTINUE TO RELY ON THIS WAIVER IN ALL FUTURE TRANSACTIONS BETWEEN THE PARTIES.

29. Governing Law & Venue

These Terms and any Dispute (whether in arbitration under Section 28 or, where Section 28 does not apply, in court) are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws principles, and (where applicable) by the federal law of the United States, including the FAA. The U.N. Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded. Subject only to Section 28, the state and federal courts located in Hudson County, New Jersey, have exclusive jurisdiction over any Dispute, and each Party irrevocably consents to that jurisdiction and waives any objection of inconvenient forum. Nothing in this Section 29 deprives a Customer of the protection of any non-waivable provision of consumer-protection law in the Customer's jurisdiction of residence.

30. State and Region-Specific Provisions

30.1 California residents

Pursuant to California Civil Code § 1789.3, California Customers are entitled to the following specific consumer-rights notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Boulevard, Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. Your privacy rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, are described in our Global Privacy Statement. Section 28 (Arbitration) is subject to the McGill carve-out described in Subsection 28(h).

30.2 New Jersey residents

Nothing in these Terms (including the limitation-of-liability provisions of Section 20 or the indemnification provisions of Section 21) is intended to limit or exclude any non-waivable right available to you under the New Jersey Consumer Fraud Act (N.J.S.A. 56:8-1 et seq.) or any other non-waivable provision of New Jersey law. To the extent any provision of these Terms is held to violate the Truth-in-Consumer Contract, Warranty and Notice Act (N.J.S.A. 56:12-14 et seq.) ("TCCWNA") with respect to a New Jersey Customer, that provision is severed as to that Customer and the remainder of these Terms continue in effect.

30.3 European Union and United Kingdom residents

Consumers retain the non-waivable protections of the law that applies to their purchase. Section 17.4 explains withdrawal for non-personalised goods where UK or EU rules apply; made-to-order production alone does not remove that right. Personalised goods retain their faulty-goods remedies. For EU dispute-resolution information, see the European Commission's consumer dispute-resolution bodies. Mandatory local protections take precedence over conflicting limitations in these Terms.

30.4 Other jurisdictions

Where the consumer-protection law of any other jurisdiction in which you are resident grants you non-waivable rights, those rights apply notwithstanding any contrary provision of these Terms.

31. Notices

Any notice or communication required or permitted under these Terms shall be in writing. Notices to the Atelier shall be sent by email to legal@creofleuratelier.com and, for any matter relating to Section 28 (Arbitration), additionally by certified mail (return receipt requested) to: Creo Fleur Atelier Corp., 50 Harrison Street, Hoboken NJ 07030, Attn: Legal. Notices to the Customer shall be sent by email to the address associated with the Customer's account or last order. Notices are deemed received on the day of delivery confirmation (for certified mail) or twenty-four (24) hours after sending (for email), absent evidence of non-delivery.

32. Assignment

You may not assign, transfer, sublicense, or delegate any of your rights or obligations under these Terms, in whole or in part, without our prior written consent. Any attempted assignment in violation of this Section 32 is void. We may assign, transfer, sublicense, or delegate our rights and obligations under these Terms, in whole or in part, without your consent and without notice, including in connection with any merger, acquisition, sale of assets, or by operation of law. These Terms inure to the benefit of, and are binding upon, the Parties and their respective permitted successors and assigns.

33. Relationship of the Parties & Third-Party Beneficiaries

Nothing in these Terms creates any partnership, joint venture, employment, agency, or fiduciary relationship between the Parties. Neither Party has authority to bind the other except as expressly provided in these Terms. Except for the Indemnified Parties under Section 21 (each of whom is an intended third-party beneficiary of Section 21), these Terms confer no benefit on, and create no right enforceable by, any third party.

34. Severability, Survival, No Waiver & Entire Agreement

Severability. If any provision of these Terms is found by a court of competent jurisdiction or arbitrator to be invalid, illegal, or unenforceable, that provision shall be reformed to the minimum extent necessary to make it valid, legal, and enforceable while preserving the Parties' original intent; if reformation is not possible, the provision shall be severed and the remaining provisions shall continue in full force and effect.

Survival. The provisions of Sections 6 (Intellectual Property), 7 (Customer Content & Reviews), 8 (Product Composition), 16 (Restricted Jurisdictions), 19 (Disclaimer of Warranties), 20 (Limitation of Liability), 21 (Indemnification), 22 (Force Majeure), 23 (Customer Conduct), 27 (DMCA), 28 (Arbitration & Class Waiver), 29 (Governing Law & Venue), 30 (State and Region-Specific Provisions), 31 (Notices), 32 (Assignment), 33 (Relationship), and 34 (this Section) survive any termination or expiry of these Terms.

No waiver. No failure or delay by either Party in exercising any right, power, or remedy under these Terms operates as a waiver of that right, power, or remedy; nor does any single or partial exercise preclude any other or further exercise of that or any other right, power, or remedy. A waiver is effective only if in writing and signed by the waiving Party.

Headings and interpretation. Headings in these Terms are for convenience only and do not affect interpretation. Words in the singular include the plural and vice versa. The words "include," "includes," and "including" mean "include without limitation," "includes without limitation," and "including without limitation," respectively.

Entire agreement. These Terms, together with the documents and pages incorporated by reference (the PDP for the product ordered, the Shipping & Returns page, and the Global Privacy Statement) constitute the entire agreement between you and Creo Fleur Atelier with respect to your use of the Site and your purchase of any product, and supersede any prior or contemporaneous understanding (written or oral) on the same subject matter.

35. Changes to These Terms

We may revise these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, for substantive changes (including any change to Section 28 that expands the scope of arbitration or class waiver), by reasonable notice on the Site or by email to account holders. Continued use of the Site after the effective date of a change constitutes acceptance of the revised Terms. Each order is governed by the version of these Terms in effect at the time the order is confirmed by Order Confirmation. The right to opt out of Section 28 under Subsection 28(g) restarts each time Section 28 is materially expanded.
